Terms of Use (EULA) - Gatex

1. Acceptance of Terms

By downloading, installing, or using the Gatex mobile application, you agree to be bound by these Terms and Conditions. This agreement applies to both Residents and Authorized Security Personnel (Guards).

2. Description of Service

Gatex is a community management platform facilitating:

For Residents: Visitor management, utility vending, emergency alerts, and community interaction.
For Security Personnel (Guards): Digital checkpoint management, QR code verification, visitor log maintenance, incident reporting, and direct resident communication for access authorization.

3. Security Personnel (Guards) Protocol

Professional Conduct for Guards: Security personnel using the Gatex Guard module are strictly bound by the following professional standards:

Verification & Access: Guards are authorized to scan QR codes and manually approve or decline visitors based on estate security protocols.
Data Privacy: Guards must not screenshot, export, or share resident contact details or visitor logs for personal use. Accessing visitor history is strictly for security audit purposes.
Incident Logging: All incidents logged via the app must be factual, professional, and free from discriminatory language.
Communication: The "Call Resident" feature is to be used solely for the purpose of verifying visitors or responding to emergency SOS alerts.

4. User-Generated Content (UGC) & Safety

Zero-Tolerance Policy: Gatex maintains a zero-tolerance policy for objectionable content. This applies to Community Board posts by residents and Incident Logs by guards.

Abusive, harassing, or defamatory language is strictly prohibited.
Users can report offensive content or block users directly within the app.
Reports are reviewed by Trimlines Technology within 24 hours. Violations result in immediate account termination.

5. Visitor Management & Liability

Gatex provides the tools for access control, but the physical security of the estate remains the responsibility of the Estate Management and their contracted security firm.

Resident Liability: Residents are responsible for the behavior of guests for whom they generate QR codes.
Guard Liability: Security firms are responsible for ensuring their guards use the Gatex app ethically. Gatex is not liable for security breaches resulting from a guard's failure to properly verify a QR code or an unauthorized "Approve" action.

6. Marketplace & Home Services Disclaimer

Gatex provides a directory for Home Service providers. Gatex and Trimlines Technology do not employ these providers. Any contract is strictly between the resident and the provider.

7. Payments & Financial Processing

Payment Processing: Gatex utilizes Paystack as our primary payment gateway. Gatex does not store or transmit credit/debit card numbers or CVV.

8. Utility Vending

Non-Refundable: All utility purchases (Electricity, Airtime, Data) processed through VTPass are final. Users are responsible for providing correct meter/phone numbers.

9. SOS & Safety Alert Disclaimer

The Gatex SOS feature is a personal safety alert and communication tool designed to notify authorized estate security personnel when a user triggers a distress signal.

Not an Emergency Service: Gatex does NOT provide, dispatch, or replace official emergency services such as police, fire, or medical response. Users must contact local emergency numbers immediately in life-threatening situations.
No Guaranteed Response: While SOS alerts are transmitted instantly within the system, Gatex does NOT guarantee that security personnel will receive, acknowledge, or respond within any specific time frame.
Role of Security Personnel: Estate security personnel are independent actors employed by estate management or third-party security firms. Gatex is not responsible for their actions, inactions, or response quality.
Location Data Usage: When an SOS alert is triggered, the app attempts to capture and transmit the user’s real-time location to designated personnel.
Location Accuracy Disclaimer: Location data may be affected by device limitations, network availability, GPS signal strength, or environmental factors. Gatex does not guarantee the accuracy, completeness, or timeliness of location information.
Limitation of Liability: Gatex and Trimlines Technology shall not be held liable for any damages, injury, loss, or harm resulting from delayed alerts, failed transmissions, inaccurate location data, or failure of security personnel to respond.

10. Account Deletion & Data Retention

Users may request account deletion via Profile Settings. In compliance with Nigerian financial and security regulations, transaction logs and security entry/exit logs may be retained for up to 7 years before permanent purging.
